Living Wage Victory

I've talked with many of you about the impact of the living wage proposal that was part of the agreement. It cuts off many of the bottom steps (in ranges 5-10) beginning November 1, 2008. I found an example of somebody in ODOT and I wanted to share what this would look like for an actual person over the next two years:

This becomes reality because so many of you stepped up and said none of your union brothers and sisters should be eligible for food stamps. I was asked to ask the following for the information of members before the vote:

The ODOT meal allowance will increase from $8 to $12 & the per diem rate will increase from $47 to $64 and be indexed to DAS policy for future increases.

Does the ODOT letter of agreement and definitions of official duty station remain the same?

Does the language that gives ODOT workers seven day per deim remain in effect?

Does all the arbitration on the ODOT language stay in effect on traveling expenses and per deim?

example; seven days at $48. = $336. If on 4/10 four days at $64. = $256. If on 5/8 at $64. = $320. a week.

Second if the language is changed or goes away and ODOT now has to go by DAS policies, do they lose the arbitration that says they get per-deim for the whole assignment on a traveling crew? There for the first and last day of the assignment is prorated, not the first and last day of each week as it use to be before the arbitration.

I will start with meal allowance, article 33.3A. Only the following classifications will be eligible to receive the $12 if they work 10 or 12 consecutive hours.

Electicians, HEM entry, 1, and 2, TMS 1 & 2, TMC 1 & 2, and TOS or their successor classifications.

This is for non-overnight meal only. The meal allowance shall not apply if any other form of travel expense is being allowed.

Now for 36.3 A,C. The first thing to notice is this is new language proposed to go into the contract and the LOA is being eliminated.

Not all of the language that was in the LOA was moved into 36.3A,C. The definition of official work station remained the same.

It was very important to continue the seven days of per diem and we successfully accomplished this. Between July 1 and October 1, 2007, the rate will remain at $47/day or $1.96/hr. On Oct 1, 2007 the rate is scheduled to increase to $64/day or $2.67/hr unless the Feds change the standard meal rate. The $64 is reached by adding the standard meal rate of $39 plus $25 for non-commercial lodging. By having the living language, if either the standard meals or the non-commercial rates change, then the rate paid to our employees will also change. The time starts with the hour the employee leaves the official workstation and ends on the hour the employee returns to the official workstation.

So what does all this mean to you on the travelling crews? It means you will receive $64/day for seven days while on assignment even if you go home on the weekend. The amount is still all inclusive, meaning you will not get mileage or incidentals or if you choose to stay in a hotel or motel.

In the past, other ODOT SEIU employees were only allowed the per diem of $47 if they stayed with family, friends, tent, etc and then stayed another night in a commercial lodging, losing the costly mileage. Thanks to arbitration, language has been added that if an employee is directed to stay at a hotel/motel, they will get the commercial lodging reimbursement rates and be allowed to claim mileage.

In addition, if an employee is lodged at agency owned facilities while on travel, they will now receive $39/day or $1.63/hr. This was an increase of $19.40.

One other note. All classifications not listed in 33.3A who work 2 hours before or after their scheduled shift and are on non-overnight travel status will be eligible to claim the appropriate meal rates.
